Appeals Court Upholds Ruling Barring Texas Inmate's Execution—-A federal
appeals court has upheld a ruling that an inmate on Texas death row for a
murder committed nearly 2 decades ago may not be executed.
A federal appeals court has upheld a ruling that a North Texas man on the
state's death row for a slaying almost 19 years ago is mentally impaired,
which means he may not be executed.
The 2-1 decision by a panel of the 5th U.S. Circuit Court of Appeals in
New Orleans was issued in the case of Eric Lynn Moore, 42, who was 1 of 4
men convicted and 1 of 2 who were sentenced to die for the December 1990
murder of Helen Ayers, 54, during a robbery at her home in Prosper, about
30 miles north of Dallas.
The other man sent to death row for the killing, Kenneth Eugene Bruce, was
executed in 2004.
